SinglePass Terms of Service
It is important that you read this
carefully because you will be legally bound to these terms.
Your access to and use of the
Service is based on your acceptance of and compliance with these Terms. These
Terms apply to all users others who access or use the SinglePass
application.
By accessing or using the Service
you agree to be bound by these Terms and accept all legal consequences. If you
do not agree to the terms and conditions of this Agreement, in whole or in
part, please do not use the SinglePass application.
PREAMBLE
Whereas
- The TechSaga (Anand Gunasekaran) has developed a SinglePass system through which it provides Customers with access to save their password or notes in his/her mobile phone or other mobile devices(the “Device”) and comprising of service options, as detailed in the TECHSAGA Mobile Service terms and conditions accessible on the TECHSAGA Website (https://outofboundexception.blogspot.com/2019/01/singlepass-tc.html) and which the customer hereby declares having perfectly understood and agreed to;

DEFINITIONS AND INTERPRETATIONS
The following expressions used in
this Agreement shall have, except where not appropriate in the context, the
meanings as described hereunder. The headings in this Agreement are for
convenience only and shall not affect their construction or interpretation. The
plural shall include the singular, the masculine shall include the feminine and
vice-versa. The terms application installer from play store shall be used
interchangeably and refers to the same person.
2.
USE OF SinglePass
2.1 Services and Transactions Offered
The services
and transactions offered in “SinglePass” may include but are not limited to the
following category:

Bank
·
Card
·
Government
·
Personal
·
Social
·
Notes
2.2 Upon due notification TechSaga reserves the right, in its absolute discretion, to amend its records accordingly without the Customer’s prior consent and terminate the Customer’s subscription to “SinglePass”.
3. AVAILABILITY
“SinglePass”
shall be available, unless otherwise advised by the TECHSAGA to the Customer from time to time, 24
(twenty-four) hours a day and 7 (seven) days a week.
4. CONDITIONS OF USE OF “SINGLEPASS”
The Customer acknowledges that:
4.1 To start using the “SinglePass”
Application, the customer must first download the Application on Google
Playstore or App Store and register himself using pin and fingerprint (if wish).
4.2 Upon registration, the Customer
shall perform action on SinglePass app
4.2.1 Log in “SinglePass”
application using his pin or fingerprint
4.2.2 Accept the Terms and
Conditions of the present Agreement
4.2.3 then can add, modify or delete information any credentials inside app

4.3 The Registered SinglePass User
shall ensure, before accessing “SinglePass”, that his smart phone, mobile
phone, tablet or any other applicable Device is not equipped with any User ID
and Password memorizing facility.
4.4 The use of and/or downloading of
any file/software from the Internet, be it from “SinglePass” or not shall be at
the Customer’s own risk and shall be subject to the Terms and Conditions
imposed by the licensor of the software which, in all cases, shall be
considered as “third party software”.
4.5 The Customer hereby formally
agrees to indemnify TECHSAGA against any claim, liability or action whatsoever
against it in connection with the use of “SinglePass”.
4.6 The Customer hereby acknowledges
that he shall participate in SinglePass Loyalty Program
5. ASSIGNMENT
The Customer
shall not assign any of its rights or obligations in the present Agreement, in
any circumstances whatsoever without the prior written consent of TECHSAGA.
6. LIABILITY OF TECHSAGA
6.1 TECHSAGA shall not incur any
liability if it is unable to perform its obligations under this Agreement due
directly or indirectly to the failure or breakdown of any machine, data
processing system, transmission link or any medium of access to “SinglePass”.
6.2 TECHSAGA shall not be bound to effect any payment in accordance with any instruction received by TECHSAGA through “SinglePass”
6.3 TECHSAGA shall not be liable in any circumstances
whatsoever for any loss or damage that the Customer may suffer as a result of
the possession, use, misuse, abuse or any form of manipulation of such a
software in accordance with clause 4.9. Furthermore, TECHSAGA shall not accept
any responsibility in connection with the suitability, performance or security
aspect of such software.
7. DUTIES AND LIABILITIES OF
CUSTOMER
7.1 The Registered SinglePass User
shall nevertheless be liable to TECHSAGA for any transaction effected through “SinglePass”
by any other person who acquired possession of the Customer’s mobile device
whether it is with or without the Customer’s consent
7.2 If the Customer suspects that a
third party knows his password or other security details, he must immediately
change his Login Password or pin
7.2.1 Duly take cognizance of the user guide
and security information as may be amended from time to time by TECHSAGA and
available on the TECHSAGA Website (https://outofboundexception.blogspot.com/2019/01/singlepass-tc.html)
, and undertake to carefully adhere to the recommended
procedures.
7.3 Any failure on the part of the
Customer to follow the security procedures referred in the present Agreement
shall amount to a breach of the present Agreement whereby TECHSAGA shall not be
held liable should any transaction be performed and/or any instruction, data or
message be transmitted through the Customer’s login credentials.
7.4 The Customer shall be solely
liable for any expenses, loss or damage that TECHSAGA or any third party may
suffer as a result of the possession, use, misuse, abuse or any form of
manipulation of such aforementioned software in accordance with clause 4.9.
7.5 The Customer further formally
and irrevocably agrees that TECHSAGA shall not, under any circumstances
whatsoever, be liable for any loss, damage, interruption, delay or
non-performance arising out of:
7.5.1 Failure by the Customer to
adhere to the present Terms and Conditions or the Customer being in
contravention with any law or regulation for the time being in force or the
Customer having furnished in correct information during the “SinglePass”
application process
7.5.2 Possession, use, abuse, misuse
and manipulation by the Customer of any third party software.
7.5.3 Any consequential, indirect or
circumstantial losses including but not limited to loss of profits, contracts
or financial losses howsoever caused or arising.
7.5.4 Unauthorized access to the
Customer’s account/s or any breach of security procedures laid down therein.
8. TECHSAGA IB credentials
TECHSAGA Pin
must always be kept secure as it is the access that will prevail upon
registration

9. Pin
9.1 The Pin shall be a six digit pin
set by the Registered SinglePass User which can be changed by the latter
through the SinglePass application.
9.2 The Pin is essential to log on
the SinglePass application and perform transactions. The Registered SinglePass
User shall, in all circumstances, keep his Pin secret, and not impart it to any
person whatsoever.
9.3 If the Pin has become known to
any person other than the Registered SinglePass User, consider change to new
one
9.4 The Customer shall have the
possibility to change his Pin on the “SinglePass” application.
9.5 TECHSAGA shall never contact a SinglePass
registered customer to request his security credentials. If the Customer
receives such a request, he shall not supply his security details in any
circumstance for he shall otherwise be liable for all transactions performed
through “SinglePass” and the use of the credentials and security details such
as the Login Password, and other data saved inside “SinglePass”
10. LOSS OR THEFT OF MOBILE PHONE
10.1 The TECHSAGA shall in no circumstances whatsoever, be held
liable for any loss, damage resulting from any notification made by phone,
telegram, telex, fax or otherwise, which might not emanate from the Registered SinglePass
User.
10.2 The Customer shall not be
entitled to alter, amend or countermand any instruction which
11. TERMINATION OF AGREEMENT
Termination
of this Agreement, howsoever occasioned, shall not prejudice or affect any
accrued rights or liabilities of either party hereunder nor shall it affect any
provision which is intended to apply after such termination.
12. MODIFICATIONS TO CONDITIONS OF
THE PRESENT AGREEMENT
12.1 By accepting to access “SinglePass”
through the use of his pin or FingerPrint, the Customer binds himself formally
and irrevocably to the Terms and Conditions herein contained.
12.2 TECHSAGA shall not in any circumstance whatsoever, be
liable for any costs, expenses or liabilities incurred or which may be incurred
by the Customer in the event of any such variation being made by the TECHSAGA .
13. GOVERNING LAW AND JURISDICTION
13.1 The Customer warrants that all
information submitted to the TECHSAGA as during the registration process is correct
and agreed on all Terms and Conditions.
13.2 If any provision of these Terms
is held to be invalid or unenforceable by a court of competent jurisdiction,
then any remaining provisions of these Terms will remain in effect. These Terms
constitute the entire agreement between us regarding our Service, and supersede
and replace any prior agreements, oral or otherwise, regarding the Service.
14. CUSTOMER ACKNOWLEDGMENT AND
DECLARATION
14.1 The Customer acknowledges that
he has been duly informed that TECHSAGA has developed a Privacy Policy with respect to
SinglePass which he should aware of and, which is made available to him on https://outofboundexception.blogspot.com/2019/01/singlepass-tc.html
14.2 The Customer declares and
warrants that all information provided to the TECHSAGA in the context of his subscription and
registration to SinglePass is true, complete and accurate to all intents and
purposes.
15.
Accounts
15.1 When you use SinglePass, You
are responsible for safeguarding the password that you use to access the
Service and for any activities or actions under your password, whether your
password is with our Service or a third party service.
15.2 You agree not to disclose your
password to any third party. You must notify us immediately upon becoming aware
of any breach of security or unauthorized use of your account.
15.3 You may not use as a username
the name of another person or entity or that is not lawfully available for use,
a name or trademark that is subject to any rights of another person or entity
other than you without appropriate authorization, or a name that is otherwise
offensive, vulgar or obscene.
16.
User-Generated Content
“Your Data” means any data and content which you upload,
store, retrieve, or otherwise make available through the Service. It’s totally
offline and TechSaga will not take any responsible of losing and tampering your
data.
17.
Limitation of Liability
TechSaga, and developer shall not be
liable for (A) any loss or damage, indirect, incidental, special, and
consequential or punitive damages, including without limitation, economic loss,
loss or damage to electronic media or data, goodwill, or other intangible
losses
